This year will mark the 25th Anniversary of the Americans With Disabilities Act, which created new rights and responsibilities for property owners, property managers and tenants in connection with access to housing. Together with Massachusetts laws and regulations which prohibit discrimination based upon disability, this act has created a number of challenging issues for attorneys and their clients, complicated by the fact that each scenario has vastly different factual considerations, which prohibits a “one size fits all” solution.
