A disclaimer trust is a pliable estate planning tool that can be used by a surviving spouse to adjust the transfer of wealth. The adjustment can have significant estate planning advantages, including tax savings, creditor protection, and flexibility for changes in circumstances. With flexibility, however, comes the diminution of control and certainty, as well as the potential for family dissension. Additionally, the timing and rigidity of the rules presents a level of complexity with potential for pitfalls. Alternatively, credit shelter trusts may provide advantages and certainty to limit dissension, but can be rigid and less flexible.
