What happens when a divorce agreement, a prenuptial agreement with a second spouse, and a will, have conflicting terms? What happens to the disposition of an asset in dispute? What happens to a life insurance policy naming the wrong person at death? And what can we, as practitioners, do in order to avoid these inconsistencies so as to ensure that our client’s wishes and intent are followed upon their death, remarriage, or divorce?
Whether preparing a prenuptial agreement, postnuptial agreement, divorce agreement, or estate plan, the importance of considering prior executed prenuptial agreements, postnuptial agreements and divorce separation agreements in order to avoid inconsistencies in the disposition of assets to beneficiaries is crucial. This CLE will provide the best practices to avoid conflicts and inconsistencies in planned dispositions of wealth through various family law related agreements and estate planning documents.
