Most personal injury, property damage, and other claims in which an insurance policy is implicated have issues of causation or damages, or coverage under the policy. Whether an attorney is representing the claimant, the defendant, or the insurer, it is crucial to understand the requirement that the insurer adjust the loss in good faith. In Massachusetts that requirement is codified in Mass. Gen. Laws Ch. 93A and 176D.
- How can a plaintiff’s attorney leverage that requirement to bring about an early and fair settlement?
