Handbook of Civil Procedure in the Massachusetts District Court

This seminar will review the four basic stages of civil money damage actions in the District Court and Boston Municipal Court—commencing the action, securing defendant’s assets during the litigation, obtaining judgment, and getting the judgment paid. For each stage, the focus will be on identifying and explaining specific procedural dangers to avoid and opportunities to exploit—for both the plaintiff’s attorney and the defendant’s attorney.

Lawyers, judges, and court magistrates depend on the presenters’ best-selling Handbook of Civil Procedure in the Massachusetts District Court. This comprehensive new edition—the  first since 2009—covers all aspects of District Court and BMC civil practices, encompassing civil litigation-jurisdiction, commencement, service of process, attachment and trustee process, motion practice, trial, judgment, and appeal to the Appellate Division.  It also has new and expanded sections on the detailed requirements imposed in recent years for default judgments, including notice to defaulted defendants, assessment hearings, and judicial findings. There’s also analysis and guidance on the new address verification rules for commencement of actions and new requirements for complaints in debt collection cases, as well as new procedures on electronic discovery, electronic filing, limited assistance representation, and special designed civil sessions to expedite litigation.
