On Tuesday, January 28th, 2020 the Social Law Library hosted Business Litigation Session - 2019 Year in Review CLE
Every year, the Business Litigation Session (“BLS”) of the Massachusetts Superior Court handles a wide variety of complex business and commercial disputes. In doing so, it decides issues not only of first impression but also other novel issues of interest to any practitioner who litigates business disputes. This CLE reviewed the most notable BLS decisions from the past year to give practitioners additional tools that they can use when they are litigating in Massachusetts (and perhaps elsewhere).
A number of significant cases were discussed. Examples include:
- Vigor Works, LLC v. White Skanska, JV. (concluding whether party can clawback privileged communications inadvertently produced despite attorney's review)
- Fidelity Brokerage Services, LLC v. Callinan, (holding whether a memorized client list is confidential information and providing best practice for communicating with former clients when switching jobs).
- Punzak v. McIvor (creating third exception to general rule that directors do not owe and fiduciary duties to shareholders)
